Hi,
I wanted to know if we can transfer an approved H1 while on OPT?
For ex Company A applies for my H1 and gets approved in May 2007 although it applies fromOct 2007. Now i get an offer from Company B before Oct 2007 say in July 2007. Can i transfer my H1 even though it starts from Oct 2007?

Dependent spouse using EAD does not invalidate your H1 status - If you use EAD then your H1 becomes invalid and your status will be "Pending AOS"

Yes, this can be done. The H-1 company needs to submit a new I-129 petition requesting a change of status for your brother. Alternatively, your brother can leave the US, apply for an H-1 visa and re-enter in H status.

NVC got my documents for 1 month
I am considering to email the NVC to check on the status of my case.
Should I email the NVC to check now (after waiting for 1 month) or wait another month (hence I would have waited 2 months) to check with the NVC on my status?

In brief, I have applied for I-485 when I was single and now priority dates are current. I need to add my spouse. Do I need to apply for I-485 for myself again? Below are the timelines.
Thanks in advance.
In August 2006.
1. Employer A
2. I was Single.
3. Files I-140 and I-485 concurrently.
4. Schedule A expired.
5. Application moved to Eb3.
In June 2007
1.Employer B (Moved in June 2007 via H1b transfer).
Married in 2008.
April 2010.
1. Employer B.
2. New I-140 filed in EB2, approved.
3. Ported EB3 PD of Aug 2006.
May 2011.
1. PD will be current in June 2011.
2. I need apply I-485 for my spouse.
Do I need to re-apply for I-485 and G-235a for the principal applicant.

Hi all,
I need an urgent advice. on April 4th I started a new job in a good size company (200+ employers). 2 week before starting the job, I had sent the company all the information required to transfer the visa (paystubs, etc etc) and they confirmed that everything was fine.
Last week (Apr 27th) I have been asked by the Payroll company to provide copy of the I-797 to attach to the I-9. I contacted the company's immigration lawyer and he stated that they filed the transfer on Apr, 26th (3 weeks after i started working for them) and he should have the receipt shortly. This caught me off guard because I was sure they already filed the application before I started working for them. I am really concerned now as I believe I am out of status (or I have been for 3 weeks).
Should I be worried? what's your take on this?
Any help would be greatly appreciated.

I am a Canadian in the "Approved I-140, waiting for 485 Limbo" status. I have a prority date of March, 2004. I find IV a good source of both information and encouragement and I would like to know there are others near me who feel the same. Hope to hear from you soon?

My friend John Lamb in Nashville blogs today about ICE's Hutto detention center where whole families are jailed while awaiting deportation. I'm reminded of Charles Dickens' tales of debtors prisons in Victorian England where "lawbreakers" who violated British laws relating to debt were jailed right along with their spouses and children. It's hard for me to tell the difference. I don't know that I blame CCA, the contractor that runs the center. Nor do I necessarily blame ICE which is simply carrying out their mission. The "A" number eventually becomes your GC number. It is not necessarily the Visa Number...we don't get to see the Visa Number.
