USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 Regular cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

Yesterday Congressman Joe Wilson talked to reporters about his claim that the President was lying about immigrants having access to health care subsidies under the President's health care plan. According to the NY Times: Im for immigration, [Wilson] said, adding that he had been an immigration lawyer, although he did not specify exactly what he had done. But people who come toour country and violated our laws, we should not be providing full services. It struck me immediately that this would be bizarre if true. Going from representing immigrants to being a member of the virulently anti-immigrant Immigration Reform Caucus...

I applied H1-B for my wife who was not in US at the time of application. The H1-B was applied as an out-of-country option. This would mean that this will not be a change-of-status automatically from H-4 to H1B from 1st Oct as it usually happens. To get into H1-B status, she will have to get it stamped outside of US. It seems her application has been selected in the lottery as we received the receipt notice on May 8th.
My question is - As now she is in US - can I change the processing to say change-of-status from H4 to H1B instead? This would eliminate her going outside the US for stamping. Please respond. Thanks.

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

Hi All,
I have two questions as below:
1) My company announced that it was acquired by another company and the deal will be closed in early 2008.
My I140 priority date is Sept 21,2007 in EB2 in Texas SC. What should I be doing assuming my I140 will be approved in 6 months time, ie March 2008.
2)Also, my company is a Federal contractor working with the Federal organisation. All employees working for this contractor will always work for this Federal organisation no matter who the contractor is.In other words, the client remains same, but contractor changes. So if this Federal organisation gives this contract to any other comapny other than I am working with, how will my I140 processing be affected.

It's just down the road. Does anyone think they'll give me a tour (on assignment from DPhoto.us) and allow me to photograph the joint with a 1D and 1Ds...

I think this is just the assembly plant. Is most of the parts from Taiwan?
I can offer an even exchange of my F2AS and F5 with your 1D and 1Ds. Someone is talking.

Article by Frank Aquila of Bloomberg BusinessWeek who underscores several reasons why lifting the cap on H-1B petitions is essential for US Tech growth including the fact that "The U.S. Labor Dept. estimates that by 2014, 2 million high-tech jobs will go unfilled simply because the cap on H-1B visas has not been raised."

It's been several years since the employment-based preference categories developed huge backlogs. However, no one was prepared for today's announcement from the State Department that most of the family-based categories will retrogress between one and three years beginning on January 1, 2011. Consider the worldwide categories: Beginning in January 1, the 1st preference category (unmarried sons and daughters of U.S. citizens) goes from a 5-year to a 6-year wait. The story is much, much worse in the 2A category (spouses and children of permanent residents) where the wait expands from a mere 4 months to 3 years, a 9-fold increase....
