    My sister is in US in Visitor Visa with I-94 expiration date of Nov 25th 2009. We would like to convert her status from B2 to F1 Visa ASAP.

    1) Do you know anyone who has changed the status from B2 and F1? If yes, can you share the experience?
    2) Is it risky to do that? What kinds of problem we may encounter?
    3) Can she stay in US while F1 is pending? what happens if rejection shows up after her current i-94 expiration date?
    4) Is it better to go home country and apply for the F1 Visa or it is safer to change the the status in US.

    Any advise you can throw will be appreciated.

    Thanks for your help.

    Graham Facing More Heat on Immigration (http://www.rollcall.com/issues/53_19/politics/19734-1.html) By Matthew Murray, ROLL CALL STAFF, August 13, 2007

    For the second time this month, a local South Carolina Republican Party committee is expected to decide soon whether to formally scold Sen. Lindsey Graham (R-S.C.) for supporting the Senate's now-stalled immigration overhaul proposal, putting the once-popular lawmaker on the defensive and upping the ante for a potential 2008 primary challenger.

    "The frustration [with Graham] is real," said one state Republican source, who added that the state's large conservative base is "just searching for someone" to challenge Graham in next year's primary.

    The Spartanburg County Republican Party is expected to vote Aug. 23 on a resolution officially rebuking Graham for supporting his chamber's immigration bill. Criticism of the reform package, which was shelved last month after failing to gather the 60 votes necessary to cut off debate in the Senate, has raged throughout the country and particularly in states such as South Carolina, where AM talk-radio hosts have bloodied the Senate proposal and said it tries to reward those who have broken the law.

    Rick Beltram, chairman of the Spartanburg County Republican Party, said he doubts a resolution criticizing Graham's stance on immigration would pass by a wide margin. But should the measure come up for a vote, Beltram already has developed a game plan to manage what likely will be an angry lot.

    "This being as explosive as it is, we would ask for a secret ballot so 30 or 40 Rep. Ron Paul [R-Texas] people yelling in the background wouldn't have an influence on the election," Beltram said.

    Last week, the Greenville County Republican Party passed a resolution censuring Graham for continuing to "adamantly support legalization of illegal immigrants." In addition to immigration, local party officials reprimanded Graham for supporting campaign finance reform and participating two years ago in the "Gang of 14," a bipartisan Senate group that negotiated a compromise on controversial federal judicial nominations.

    The resolution also criticized Graham's recent statements before the National Council of La Raza, which were captured by cable news networks.

    "We are not going to run people down. We are not going to scapegoat people. We are going to tell the bigots to shut up and we're going to get this right," Graham told the crowd.

    Samuel Harms, the Greenville GOP chairman whose group adopted a resolution in 2001 "opposing any legalization of illegal immigration," said Graham's speech to La Raza was the "straw that broke the camel's back." He added that the resolution was "about informing people that Lindsey Graham called the good people of Greenville bigots and that we need to be told to shut up."

    A successful censure vote next week in Spartanburg may signal a widening opportunity for a potential Graham challenger next year. So far, Graham faces only token primary opposition and last month he dodged a potential bullet when popular state Treasurer Thomas Ravenel (R), who was considering a run, was arrested for allegedly distributing cocaine.

    Democrats have yet to find a challenger to the first-term Senator.

    After recapturing some of the love lost during his Gang of 14 days, a GOP source said Graham's recent bruising for supporting the immigration bill may convince some conservative party activists that an opportunity is again at hand. Also, Graham's support of tanking presidential candidate Sen. John McCain's (R-Ariz.) campaign, the source said, is not helping his cause.

    "The immigration issue reignited the ember," the source said.

    Still, with Graham sitting on $4 million in the bank, potential primary challengers face a steep uphill battle contending with an incumbent who may have twice that total squirrelled away before the year's end. Lt. Gov. Andr� Bauer (R), frequently said to be mulling a run, told Roll Call last week that he has not ruled out the possibility of challenging Graham.

    "I would never say never," Bauer said. "But I don't have any plans to run against him."

    But Bauer does plan to appear at the Aug. 23 meeting of the Spartanburg County GOP.

    Katon Dawson, chairman of the South Carolina Republican Party, said that while it's unusual for party activists to go to such extremes with federal officeholders, the immigration issue has struck a nerve with the party's base.

    "You can't bluff it, you can't beat around the bush about it, it's there and it's real," he said. "Lindsey has a different philosophy on immigration and there's no question it's hurting him."

    For now, Graham appears to be resting on his conservative laurels and betting that the controversy will pass. Graham currently is out of the country, his campaign said Friday, but will return to the state to campaign later this month.

    "Lindsey Graham is a strong conservative voice in the U.S. Senate with a lifetime conservative rating of 91," according to a statement provided by spokesman Scott Farmer. "He will seek re-election based on his conservative voting record and willingness to tackle the hard problems facing our nation."

    Whit Ayers, a Republican pollster, said immigration undoubtedly is a challenging issue, but one that plays to Graham's strengths. Even more, despite the current controversy, Ayers said voters ultimately respect lawmakers who take principled positions.

    "Sen. Graham is a remarkedly adept politician who will be able to be very persuasive about the reasons why he's done the things he's done," Ayers said. "I don't think we would expect our politicians to be in lock step on every single issue that comes up."

    He added: "There's no question that Lindsey Graham is right where most Republican voters in South Carolina are on God, guns, gays and taxes."

    Hello Guru�s

    I am currently on F1 and will be graduating in December 2007. In August filed I485/EAD/AP through spouse. Now I am planning to change my status from F1 to H4 to maintain the status till I485 is approved.
    1. I want to know will my COS from F1 to H4 affect my 485 application as I haven�t received the receipt notice yet.
    2. Should I apply for H4 right away or wait until I receive I485 receipt notice and EAD card?
    3. How long does it take to get H4 approval?
    4. How long, before I graduate should I apply for H4?
    5. Is it a good idea to change to H4?

    AP approved a week ago and I had another LUD on 8-12-07.

    I know a bunch of people had similar LUD on their 140s. I am thinking it could be a database issue. No impact..

    Hi

    I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.

    So I would like to know the options that I have to get my visa status changed to H1b.


    1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
    If it is, how can I change my status?

    2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?


    Please kindly reply to my questions.

    Hi,
    We filed our 485s during the July 2007 fiasco. We moved after an year, so we updated USCIS with our new address by filling AR11 online for all the petitions(485s, 140)
    My 485 status is in pending state but by husband's petition has a status of "Notice Returned as Undeliverable". Now it is more than 6 months since that update. Do I have to follow up on it? Any input appreciated. Thanks much in advance.

    WASHINGTON -- Down in the polls, House Democrats are showing a little more finesse as they try to move their legislative agenda around the wall of veto threats thrown up by President Bush.

    Cute is out; conciliation is in. Late-night talks with Republican moderates intensified last week on the Democrats' signature health- care initiative -- extending coverage to millions of working class children. Staff negotiations continued during the holiday weekend, and Georgia Rep. Nathan Deal, a Democrat-turned-Republican with expertise on health and welfare issues, has been invited in by both sides as a broker.

    House Appropriations Committee Chairman David Obey (D., Wis.) last week abandoned a confrontational plan to pair defense and education budgets, which would have dared the president to veto both. Instead the two bills were sent separately to Mr. Bush, who could veto the education measure as early as today. Looking ahead to the override vote, Mr. Obey took care to preserve House Republican provisions regarding abortion, child vaccines and abstinence education.

    The House is scheduled Thursday to take up an antipredatory lending bill that is a showcase of cooperation between the chairman of the House Financial Services Committee, Rep. Barney Frank (D., Mass.) and his ranking Republican, Rep. Spencer Bachus of Alabama.

    "He called up and said why don't you come down to my office and tell me what you need to be on the bill," said Rep. Steve LaTourette (R., Ohio) of his own dealings with the chairman. Mr. Frank is a close ally of House Speaker Nancy Pelosi and has urged Democrats to permit more Republican amendments as a way to change the political tone in the House.

    "It's transactional -- you have to see what it brings," Mr. Frank said. "But Hubert Humphrey once said, 'Whenever I get cute, I blow it.' That's the same thing I'm saying: if you try to be too political there's a backlash."

    That backlash is evident: Congress's approval rating has fallen from 31% in March to 19% this month in the latest Wall Street Journal/NBC News poll.

    A year after returning to power, House Democrats are at a crossroads. The party's early agenda -- tougher ethics rules, a minimum-wage increase and more aid for college students -- is largely in place. To go further, the majority must overcome not just presidential vetoes but the often-crippling partisan bitterness left from 12 years under Republican rule.

    The war in Iraq, which permeates Washington and again divides the House this week, makes that cooperation harder. As the president lays down vetoes, he seems to prefer a divided Congress that poses less of a challenge. And the Senate's filibuster rules, which require a 60- vote supermajority just to get a bill to the White House, are an added frustration for House Democrats.

    Allies of Ms. Pelosi said she could do more to take the lead and soften the tone in the House by using her power over the Rules Committee to allow more Republican amendments.

    Last month's floor fight over the Foreign Intelligence Surveillance Act -- a controversial arena relating to the government's wiretapping activities -- is a case in point. The Rules panel disallowed all 27 Republican amendments. The minority retaliated with a procedural motion that successfully forced the bill to be withdrawn, and it still hasn't come back up for debate.

    Ms. Pelosi's combative nature doesn't make such a shift easy. When the president recently accused Democrats of being led from the left by the anti-war group Code Pink, she saw it as a slight on her and responded in kind, saying Mr. Bush was acting less like "the president of the United States" than a "a junkyard dog on television every day because he has nothing to produce."

    Going into 2008, the Californian said her party is well positioned on the issues most important to voters. Democrats think the child health-care fight is a long-term winner with bipartisan appeal. Party polls show her next priority, an energy bill that demands that cars be more fuel efficient, would appeal to independent voters. And tougher safety standards for imports from China is a third bipartisan issue that Democrats hope will improve Congress's image and is a reminder of Ms. Pelosi's early human-rights record on China.

    "Nothing is a setback, we're going forward," she said, sitting in her Capitol office.

    Ms. Pelosi's tough style borrows from her hero: the late Speaker Thomas "Tip" O'Neill of Massachusetts. Another Boston politician, and an O'Neill ally, Joseph Moakley, may be more relevant in Ms. Pelosi's predicament.

    Mr. Moakley, a former chairman and long-time fixture in the House Rules Committee, lived by the maxim that he was in power to "say yes, not no."

    "I always thought real power was the ability to say yes," Mr. Moakley said months before his death in 2001. "Because when I'd say yes, I found out they'd usually say yes back to me."
