Does any one have any advice about AC21
Is it advisable to file AC21 soon after changing/ joining new employer?
OR
Just keep quite and look for any RFE, if any RFE comes up send AC21 form and updated employer information along with it.
IS there any guidelines from people who already did it successfully

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.

I just realized a stupid mistake was made after filing my COS from F1 to H1B. My employer sent the entire application this Monday to Vermont Premium Processing Center. I had no idea that the I-539 was not even needed and that I-129 and I-907 were sufficient enough to proceed with the COS. Anyway, is there a way to correct this error? I'm just hoping USCIS won't reject my application and just process my COS.
I included a separate check worth $300 to pay for the I-539 but the rest of the payments were issued by my sponsoring employer. I really thought I-539 was one of the requirements so I went ahead and included it.
Any input will be appreciated.

Hi, my husband was killed in a road accident. He was on J1 and had very good publications and this happened when we were just wanting to apply for our green card, as he had very good credentials we would have got it without any problems. We had dreams of sending our daughter to best school for her college. Now with life turning upside down, I am enrolled in grad school to work on my phd and will take a while, but with this tragedy being recent dont really know how long its going to take to complete it and how future would be.
I want to know if there is any possibility that I can apply for immigrant visa on humanitarian grounds as it would be very difficult for me to live in India my home country due to social reasons as a widow with a little daughter.

I work for one of the biggest software companies which deals with PERM cases a lot. However, my case got audit notice and I'm really confused now.
My PD is Jan-19-2009 and I received my audit notice in 11/2009, and we replied in 12/2009. I just learnt today that it might be very likely to take more than 2 years to clear such a case and there is possibility to be denied.
I'm very worried that I might lose my PD, is it really true that my case won't be cleared for at least another year?

I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.

The couple applied for the green card together. The husband applied under the EB1 category and his wife also applied with him as dependent. The green card of the couple has been approved and is expected to arrive in a month's time. The wife is not in US currently. She is outside US. Will the husband get his green card & the wife's green card in his wife's absence? Will there be any complications in the husband's green card in this case?

1. Husband becomes a LPR this year.
2. Wife still undocumented.
3. Wife was working long time ago, but became a housewife for the past 6 years, so no work.
How would the wife adjust her status under the new CIR if she was not working for the past 6 years?
Would she have to wait until the husband is able to petition her through other regular means?
Any ideas or is it too early to tell how USCIS will issue it's regulations about CIR?

Recently I have travelled to USA on B1, during port of entry at chicago the immigration officer as marked Advised on the stamp with pen. What does it mean? Does this will have any impact on my next visit to USA on B1.
In port of entry letter I have mentioned stay duration as 4 weeks (1 month). Is this the problem? If so why officer given i-94 till 3 months?
