In above link, how is it possible to have pending I-485 (EB2) for 2008 & 2009 for India? If i remember correctly the priority date for India has reached upto Jul 2007 only so far.
could someone pl. educate me?

If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.

My friend currently is in his home country. He worked with H1-b before, and left US because of being laid off (could not found a new job in time). His question is if he can apply for B2 and go to the US first, then stay in US looking for a job. After getting an offer, transfer his previous H1-b to a new company. Can he do like that? Thanks!

You should bring evidence of your strong ties to the country where you live now - evidence of a job, family, house, club memberships, bank accounts, etc. Anything you can think of that would show an immigration officer that you really intend to return home at the end of this trip.

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

I have a 3year degree in Bachelors of Science (Maths) and a 1 year degree in BS in Computer Information systems from Golden Gate University in (San Francisco, CA). However at the time of my GC filing, my lawyer advised me that i cannot file for EB2 but for EB3, since my bachelors degree does not evaluate to a 4 year US degree (based on the single source rule). So i had to file my I-140 in EB3.
Recently i read an article on murthy.com http://www.murthy.com/news/n_combdg.html this article clearly mentions that the person I-140 was denied by USCIS but the AAO overturned the case. I asked my lawyer about this, she says that even thought the person had two degree, they were from the same university, but from my understanding ethiraj college is an autonomous university.
I have a feeling my case is similar, what do you'll think i should do..

I currently hold H4 visa. I got H1 approval (consular) this year. Now instead of applying by consular process (in London), I want to join my spouse on H4 and then apply for COS from within USA.
1. Can I do this?
2. If Yes, how? Which form do I have to fill ? Kindly detail the procedure with applicable costs.
3. When I later, travel outside US, do I then have to have H1 visa stamped in my passport?
4. If Yes, does this 1st visa have to be from home country or could be from Canada etc.?
P.S. I do not have any educational or work background in USA.

I have thought about Self-employment but it sounds like it is risky. Are there any good consulting companies which charge very less percentage for having me as an employee on EAD. I hope that company can send AC21 and continue my GC processing.
