Folks,
I am trying to put together documents for my wife's 485 application. The birth certificate was re-issued a couple of years back (with corrections to her mother's name and including her last name which was missing earlier).

The lawyer says we need to put a good reason down for 'why a corrected birth certificate was not obtained until now'.

Do you guys know of a good reason to provide USCIS? Know of any reason which was accepted in case of your friends?

Hi,

Currently i am working as full time employee on H1B, receiving W2. I have EAD valid until Oct 2010.

Can i use EAD to work part time and receive 1099 as income statement? If i use EAD / 1099 will this cause an issue for I-485 approval (AOS is pending) ?

you are right buddy. My husband was telling me the same thing today. If they can do what they did today, they are capable of pulling any tricks on us. I have also lost trust in this system. I am now more scared than ever for some reason.

One of the stand out football players for the United States Military Academy at West Point is junior Alejandro Villanueva, a Spaniard who played high school football in Belgium. The wide receiver is also the tallest player in all of college football - 6 foot, 10 inches. Villanueva will have to serve five years in the Army after graduating and will probably be deployed to Afghanistan or Iraq. I have B1/B2 Visa for 10 yrs and travelled to USA earlier and also planning to VISIT USA on B1/B2 Visa in the last week of July for just 10 days.
The doubt is that - "since I have H1B Visa CASE APPROVAL, can I travel to USA on B1/B2 Visa"
Someone suggested that I can travel but it is NOT ADVISABLE!!

Hi, my BIL was on H1, and lost his job, then he moved on to EAD, which he hadnt because my sister was on h4, then my sister got a job and went to home country to get it stamped as advised by their lawyer. Now her visa got rejected, maybe bec the company she got the job in is not very big. Anyway now for her to come back, my BIL has been advised to go back on H1.

My questions are:
1) How safe is it to go from EAD to H1
2) Is it true that if you are on EAD and then if you try to go back to H1 the chances of it getting rejected are high? And if your H1 gets rejected then there are chances that your EAD will also get rejected?
3) How long does it take to move from EAD to H1

Any insights/suggestions/advises on the above would be greatly appreciated.

Filed extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009

Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009

What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?

Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

Kindly suggest.
