    I don't understand how removing the country limit may have resorce implications, as how I understand is, instead of adjucation an EB-2(2008) from Mali you'll be adjucating an EB-2(2004) from India, what difference it is for them ???

    he talks about amnesty to people who stayed illegally for 10 years
    How about staying legally for 10 years...

    The Democrats falsely accused the anti-amnesty forces of "opposing immigration" and "racism." Actually more Democrats voted Nay.

    I though Kennedy was pro immigration...looks like he just cares about illegal immigration..

    Lets ask the so called pro immigration senators who voted naey...why they did it
    Arent they aware of the USCIS wasting so many visas and plight of legal immigrants
    They want to convert illegals to legal...

    Thanks for ur support and understanding. I think we better let these guys take a shot at what they are about to do. Immature and narrow minded is what they are and thats how they wanna be. Looks like they've been watching those Indian vigilante movies a lot and they think that they can get away with fighting a foreign Govt agency. They'll understand what we meant when they receive a cold shoulder from USCIS :D.

    No worries mate. Just trying to help clear things but I get rebutted all the time and I'm sure they are misinterpreting me.

    I have nothing against them and as part of IV, I am just voicing an opinion which they could reject politely.

    Some of the comments on my comments are really harsh as if I am personally attacking them.

    You are right, it will be tough to dig into an agency that does approve your status here.

    They can do whatever they want and good luck to them.

    BTW, I used to have several red dots before and I don't know why they changed it to green. They still have a block on one of my IP address.

    All,

    When this July bulletin was released, I had given the following points in that thread.
    I am seriously considering this. Indian economy is going to go leaps and bounds and I dont want to miss out on that. And wait here in the whims and fancies and their ridiculous illogical visa bulletins by these people. They shouldnt harass and take Indians for a ride. We are paying our taxes and all the fees and what not. Still they prefer illegals over us.
    Enough is enough. I have self respect.


    Looking at this visa movement for the past year and the current economy, I am just giving up hope to get GC in this country folks.
    I am seriously thinking about going back to India. The reasons I was proding over are:
    1. Well.. first and foremost, no hope of visa movement in near future.
    2. Employer uncertainty. The company is not doing too well.
    3. Tough job market and US economy will drag like this for another 2-3 years.
    4. If they lay me off, I will have to find another job first. I havent even applied for 485 yet, so no EAD and priority date is Feb 2008
    5. Restart GC again which is another excruciating process - moneywise, timewise.
    6. Wait again in the line for visa movement
    7. No career advancement because cannot jump companies and I am already early 30's. (I am non-IT). Career is stagnant, company doing very small projects.
    8. Cannot even think of having kids because job and life here is hanging by a thread.
    9. Cannot buy a house in this market. Its not that I dont have money, was thinking, if I lose the job, I wont get much time to sell it off and I will have to incur losses.
    10. India is doing well and going to to do well in the future.

    Is anyone else thinking on these lines?

    If you don't mind which area are you in ? Oil/Mining/Finance sector ?.
    You can try the Canada option like me. Lately Alberta/Canada closed
    the door for IT people, therefore I am wondering if you have other options in Canada.

    Thats ridiculous. I recently bought a home and got FHA loan from Chevy Chase Bank. To my surprise, they did not ask me a single immigration related document or any proof of legal presence. All they ever asked was a valid ID during closing, and I showed them my drivers license.

    Hi eb3retro,
    I understand from your signature that you Receipt date is 7/2/07. was your case transferred to Vermont or something and transferred back to TSC. Do you know what was the Receipt date mentioned in the Transfer Notice. I am just trying to guess when they may come to my case. My receipt date for 485 was from Vermont and is 7/31/07. But then it was transferred back to Texas and this has a Receipt date of 10/1/07. I am just trying to find out which Receipt date will be considered to pre-adjudicate my application. Thanks.

    I do not know if USCIS is going with receipt date or any procedure. My Receipt date is June 27, 2007. Notice date is August 9, 2007. My case is not touched either till now.

    Yes, regarding recapture for family based only. If you add employment one you are talking about 200K total.

    I have talked to a representative and he very patiently explained me about the mess.
    He clearly and very clearly told me that they have a deadline to send all receipts for June end and July 2nd filers by friday (tomorrow) or worst case monday.

    He mentioned that they are working hard to meet this deadline.
    Hope this clears the anxiety.

    H1B believe it or not is a "dual intent visa". F1 is NOT a dual intent visa. So what that means is even tho a person entered USA on H1B(which is Nonimmigrant visa) he can have a dual intent to "adjust status" and become a permanent resident.

    So I would think it would very wise to be given a PD based on when a person started working on "H"

    Coming in through H1 does'nt show your intention of becoming a permanent resident of this country. It only happens when the LC is applied. Although the entry date is an ingenious way, it will only create more issues. Now some one who comes in F1 can also ask for the same benefit when they move to H1, to take their entry date in F1 as their priority date. I believe the culprits are the labor substitution and the labor certification sales. Those are unfair. Stop labor substitutions, and if they need one, then use the 140 RD as the PD. That should solve most of the problems and people from using labor sub to jump the line.

    I am writing to you to express my sense of helplessness over the unpredictability of Visa Number allotment to various employment based category. I want to bring to your attention that it�s been nearly a �Decade� since we saw any meaningful Visa Date movement from year 2001 for EB-3 Green Card applicants from India.

    It is important to know that despite of severe visa retrogression and random visa cutoff date movements, USICIS or DOS hasn�t released any official information on how many Adjustment of Status applications are pending at USCIS under various categories which leaves thousands of AOS(Adjustment of Status) applicants in complete darkness and dependent on guessing games by various Law firms.

    A green card application requires enormous amount of efforts and money from the beneficiary and his/her employer. People who are waiting for 7-8 years now would have had already spent average $15,000-$20,000, in maintaining their statuses and keep the Green Card process going on. Being stuck in a green card process keeps us bonded with 1 employer, job type etc.
    We need to know if there is any light at the end of the tunnel. We need to know for how long we have to live our life in limbo. If there is hope than we need to be patient and plan to live like that for another 1-2 years. But if there�s no light at the end of the tunnel than we need to move on with our careers and other family commitments. Only your office and USCIS can help us by releasing statistics on the number and categories of applications pending with USCIS people waiting in this category can plan their lives accordingly.

    It will be a great help if DOS or USCIS could tell us about the number of AOS application pending at USCIS along with their Categories(EB-3, EB-2, EB-1) and chargeable country.
    We have been waiting for a decade and continue to wait would it be reasonable to request you for some guidance with regards to the Visa allotment. I request your office to provide some statistics on home many Adjustment of Status applications are pending at USCIS.



    We understand that you work with in the limits of the law as set by the Congress and are limited by various constraints that are beyond your agency realm of work. We appreciate your hard work and sincerely thank you for all the hard work.

    anyway, i just wanna ask about what you said earlier.. is it true that there are some August scheduled embassy interviews being cancelled? what did those people you know exactly said about this?

    Yeah, PD is April 2005 EB3ROW, and its just frustrationg when you see a lot getting their approvals with a much later PD's. He was scheduled for interview in Aug. she already recieved her packet 4 when Aug vb came out and reinstated July VB. I knew that it had something to do with July vb fiasco since he got his packet 4 after July 2. There were no visas left for that time, so AUg. vb doesn't really matter.

    got an RFE on my case alone, not sure abt the details, since i have not recieved it in hand. you can know my PD details in the signature.
